This website is operated by LYDovate. Throughout the site, the terms "we", "us" and "our" refer to LYDovate. We offer the ViolaRead system, which includes both a web application and a browser extension, to enhance your online reading experience. The ViolaRead system comprises:

  • ViolaRead Browser Extension: Enhances the readability of online content by providing text processing, interactive reading tools, and data analysis features. The extension processes content directly from web pages while respecting user settings and privacy controls.
  • ViolaRead Web Application: Manages user accounts, subscription plans, and personalized settings. It integrates with third-party services (such as Google OAuth for authentication, Stripe for payment processing, Firebase Firestore for data storage, and PostHog for analytics).

By visiting our site and/or purchasing or activating any ViolaRead services, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including any additional policies and conditions referenced herein or available via hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers, merchants, and contributors.

Please read these Terms carefully before accessing or using any part of our website or ViolaRead services. If you do not agree to these Terms, you may not access the website or use any part of the ViolaRead system. Any new features or tools added to our system are also subject to these Terms. We reserve the right to update or change these Terms at any time; your continued use of the website or ViolaRead services constitutes acceptance of any changes.

SECTION 1 – ELIGIBILITY AND SERVICE USAGE

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction or have obtained permission from a parent or legal guardian. You agree to use our services only for lawful purposes and in accordance with these Terms. Unauthorized use or violation of these Terms—including using the extension or web application for any illegal or harmful purposes—may result in immediate termination of your access to the services.

SECTION 2 – VIOLAREAD SYSTEM – PRODUCTS AND SERVICES

The ViolaRead system is offered through two main components:

  • ViolaRead Browser Extension: Enhances the readability of online content by providing text processing, interactive reading assistance, and data analysis features. The extension processes content directly from web pages while respecting user settings and privacy controls.
  • ViolaRead Web Application: Manages user accounts, subscription plans, and personalized settings. It integrates with third-party services (such as Google OAuth for authentication, Stripe for payment processing, Firebase Firestore for data storage, and PostHog for analytics).

These products may have limited availability and are subject to our Return and Refund policies. We strive to display accurate colors, images, and descriptions; however, discrepancies may occur based on your device or browser settings. All product and service descriptions are subject to change without notice.

SECTION 3 – USER DATA, PRIVACY, AND DATA COLLECTION

Your privacy and data security are important to us. When you use ViolaRead, we may collect and process various types of data including:

  • Personal Information: Such as your email address, account preferences, and subscription details, which are managed via the ViolaRead Web Application and secured using industry-standard encryption.
  • Usage Data: Information on how you interact with the ViolaRead Browser Extension and web application. This includes anonymous usage metrics, reading behavior, and feature usage statistics.
  • Payment Information: Handled exclusively by third-party payment processors (e.g., Stripe), with no sensitive payment data stored directly by us.

SECTION 4 – MODIFICATIONS, UPDATES, AND TECHNICAL CHANGES

We reserve the right to update, modify, or discontinue the ViolaRead services, including the browser extension and web application, at any time without notice. This includes changes to features, data collection practices, and pricing. You agree that LYDovate shall not be liable for any modifications, updates, or discontinuances of the service.

SECTION 5 – BILLING, SUBSCRIPTIONS, AND ACCOUNT INFORMATION

  • Account Management: You agree to provide accurate, complete, and current account and billing information. It is your responsibility to update this information as needed.
  • Subscription Services: The ViolaRead Web Application offers various subscription tiers (Free, Casual, Premium) managed through Stripe. Payment processing is subject to Stripe's terms, and any issues with billing or subscription cancellations will be handled in accordance with our Refund Policy.
  • Order Restrictions: We reserve the right to limit orders, subscriptions, or access to services based on factors such as usage patterns or geographic region.

SECTION 6 – USE OF THIRD-PARTY TOOLS AND SERVICES

Certain components of the ViolaRead system may use third-party tools and services (including but not limited to Google OAuth for authentication, Stripe for payment processing, Firebase/Firestore for data storage, and PostHog for analytics). We do not control these third-party services, and their use is subject to their respective terms and conditions. Your use of these tools is at your own risk, and we are not liable for any issues arising from their use.

SECTION 7 – USER CONTENT AND FEEDBACK

Any feedback, suggestions, or content you submit regarding ViolaRead may be used by us without compensation or restriction. By submitting such content, you grant LYDovate the right to edit, publish, and distribute your submissions. You are solely responsible for ensuring that your submissions do not violate any third-party rights or contain harmful material.

SECTION 8 – INTELLECTUAL PROPERTY

All content, tools, and services provided as part of the ViolaRead system are the property of LYDovate or its licensors. You agree not to reproduce, duplicate, or otherwise exploit any portion of the service without explicit written permission from LYDovate.

SECTION 9 – PROHIBITED ACTIVITIES

You are expressly prohibited from:

  • Using the service for any unlawful purpose;
  • Violating any applicable laws or regulations;
  • Uploading viruses or malicious code;
  • Engaging in data scraping, reverse engineering, or any activities that may disrupt the functionality or security of the ViolaRead system;
  • Misrepresenting your identity or origin when submitting user content or feedback.

Violation of these provisions may result in immediate termination of your access to the ViolaRead services.

SECTION 10 – GEOBLOCKING AND JURISDICTIONAL RESTRICTIONS

The gradient text feature provided as part of the ViolaRead system is subject to specific geographical restrictions. In particular:

  • Restricted Jurisdiction: This feature is geoblocked and is illegal to use in France in accordance with local laws.
  • User Responsibility: Users located in or accessing the service from France, or any jurisdiction where the gradient text feature is prohibited, must refrain from using this feature.
  • Technical Enforcement: We implement technical measures, including IP geolocation, to enforce these restrictions. Circumventing these measures is strictly prohibited.
  • Legal Consequences: Any attempt to bypass these restrictions may result in immediate termination of your account and potential legal action. LYDovate disclaims any liability arising from the unauthorized use of the gradient text feature in restricted jurisdictions.

SECTION 11 – DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The ViolaRead system is provided on an "as is" and "as available" basis. LYDovate does not warrant that:

  • The service will be uninterrupted, error-free, or secure;
  • The results from using the service will be accurate or reliable.

You agree that your use of the service is at your sole risk. In no event shall LYDovate or its affiliates be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use the service.

SECTION 12 – INDEMNIFICATION

You agree to indemnify and hold harmless LYDovate, its directors, officers, employees, and affiliates from any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the ViolaRead system.

SECTION 13 – SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect. The unenforceable portion will be considered modified to the minimum extent necessary to render it enforceable.

SECTION 14 – TERMINATION

You may terminate your use of the ViolaRead services at any time by ceasing to use the website and/or the browser extension. LYDovate may also terminate or suspend your access to the service immediately if you violate these Terms. All obligations incurred prior to termination shall survive.

SECTION 15 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and LYDovate regarding the use of the ViolaRead system and supersede any prior agreements, communications, or proposals. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 16 – GOVERNING LAW

These Terms, and any separate agreements whereby we provide services, shall be governed by and construed in accordance with the laws of Sweden.

SECTION 17 – AMENDMENTS TO THE TERMS OF SERVICE

We reserve the right, at our sole discretion, to update or modify these Terms at any time. It is your responsibility to review this page periodically. Your continued use of the ViolaRead services following any changes constitutes acceptance of those changes.
